2.3 We may process transaction data which includes your contact details, card details and transaction details. The transaction data may be processed to supply the purchased goods and services and keep proper records of those transactions. The legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into a contract and our legitimate interests, namely our interest in the proper administration of our business.

2.4 We may process information that you provide to us to subscribe to our email notifications and/or newsletters called notification data. The notification data may be processed to send you the relevant notifications and/or newsletters related to our services offered on our website. The legal basis for this processing is our legitimate interests, namely communications with our customers between you and us and/or taking steps, at your request, to enter into such a contract.

2.5 We may process service data which may include credit card payment details or any other payment details. The source of the service data is Powermetrics. The service data may be processed to provide our best services, ensure the security of our services, maintaining the back-ups of our databases and communicating with you. The legal basis for this processing is our legitimate interests, namely the proper administration of our business.

2.6 We may process data that include first name, middle name, last name, email id, job title, name of the company, etc. The source of this data is Powermetrics. This data may be processed for business purposes specified on Powermetrics. The legal basis for this processing is our legitimate interests, namely the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

2.7 We may process any of your personal data identified in this notice whenever necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or an administrative or out-of-court procedure. The legal basis for this processing is our legitimate interests, namely the protection and assertion of our legal rights, your legal rights and the legal rights of others.

2.8 We may process any of your personal data identified in this notice whenever necessary for obtaining or maintaining insurance coverage, managing risks, or obtaining professional advice. The legal basis for this processing is our legitimate interests, namely the proper protection of our business against risks.

2.9 In addition to the specific purposes for which we may process your personal data set out in this Section 2, we may also process any of your personal data where such processing is essential for compliance with a legal obligation to which we are subject, or to protect your vital interests or the vital interests of another natural person.

3. Providing your personal data to others

3.1 We may reveal your personal data to any member of our group of companies; this means our subsidiaries, our ultimate holding company and all its subsidiaries in so far as sensibly necessary for the purposes, and on the legal basis, set out in this notice. 3.2 We may reveal your personal data to our insurers and/or professional advisers insofar as reasonably necessary for obtaining or maintaining insurance coverage, managing risks, obtaining professional advice, or the establishment, exercise or defence of legal claims, whether in court proceedings or an administrative or out-of-court procedure.

3.3 We may specify the personal data category or categories to our suppliers or subcontractors identified at Powermetrics in so far as reasonably necessary for purposes defined on Powermetrics.

3.4 Financial transactions relating to the services are handled by our payment services providers, like PayPal, Stripe etc. We will share the transaction data with our payment service providers only to the extent necessary for processing your payments, refunding such payments and dealing with complaints and queries relating to such payments and refunds. 3.5 In addition to the specific disclosures of your personal data set out in this Section 3, we may disclose the personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

4. International transfers of your personal data

4.1 In this section 4, we provide all the information about the situations in which your personal data may be transferred to countries outside the European Economic Area (EEA).

4.2 We have offices and facilities in England and Wales. The European Commission has made an “adequacy decision” with respect to the data protection laws of each of these countries. Transfer of information to each of these countries will be protected by appropriate safeguards, namely the use of standard data protection clauses adopted or approved by the European Commission, a copy of which can be obtained from Powermetrics if you need.

5. Retaining and deleting personal data

5.1 This Section 5 sets out our data retention policies and procedure, which are designed specially to help in ensuring that we comply with our legal obligations in relation to the retention and deletion of personal data.

5.2 Personal data that we process for any purpose/purposes shall not be kept for a longer period of time than is necessary for that purpose or those purposes.

5.3 We will retain your personal data as follows:

  1. Personal data category or categories will be retained for a minimum period of 30 days and for a maximum period of over 90 days following the date of the first usage.

5.4 In some cases, we can’t specify in advance the periods for which your personal data will be retained. In such cases, we will determine the period of retention based on the following criteria:

  1. the period of retention of the personal data category will be determined based on the duration of the last usage.

5.5 Notwithstanding the other provisions of this Section 5, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

6. Security of personal data

6.1 We will take any appropriate technical and organizational precautions to secure your personal data and to prevent the loss, misuse or alteration of your personal data.

6.2 We will store all your personal data on secure servers, personal computers and mobile devices, and in secure manual record-keeping systems.

6.3 The following personal data will be stored by us in encrypted form like email ids, name, job title etc.

6.4 You acknowledge that the transmission of unencrypted or inadequately encrypted data over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

6.5 You should ensure that your password used to access our software and IT systems are not susceptible to being guessed, whether by a person or a computer program. You are responsible for keeping the password confidential and we will not ask you for your passwords at any time except when you log in to our software and IT systems.

8. Your rights

8.10 To the extent that the legal basis for our processing of your personal data is:

  1. consent; or
  2. that the processing is necessary for the performance of a contract to which you are a party or in order to take the necessary steps at your request before entering into a contract, and such processing will be carried out by automated means, you have the right to receive your personal data from us in a structured, commonly used and machine-readable format. However, this right does not apply where it would adversely affect the rights and freedoms of others.
